ZANESVILLE - A man who raped a young girl and her mother was sentenced this week to life in prison with the possibility of parole after 20 years.
Sean S. Payton, of Zanesville, previously pleaded guilty in Muskingum County Common Pleas Court in two separate cases to two different counts of rape, both first-degree felonies.
As part of his sentencing, Payton was also classified as a tier three sex offender and required to register as such every 90 days for life.
"The underlying facts in these cases are basically unspeakable," said Assistant Muskingum County Prosecutor John Litle.
Payton spent three years raping the child, Litle said in court. The child was 10 years old when she told her neighbor about the abuse. During the investigation of that case, Payton then broke into the victim's home, searching for her, and then raped her mother at knife point.
Litle asked for the maximum possible sentence, which was life in prison without the possibility of parole after 21 years.
Payton's defense attorney, Keith Edwards of Columbus, argued for concurrent sentences, meaning that Payton would serve life in prison with the possibility of parole after 10 or 11 years. Edwards said Payton accepted responsibility and did plead guilty to the charges.
The adult victim had previously asked for Payton to receive counseling instead of punishment with regard to her case, Edwards said, but had since written a letter requesting the maximum sentence.
Since a previous Times Recorder article about Payton's crimes was published, Edwards said the adult victim has been harassed and received death threats, which he believed motivated her to change her mind about Payton's sentence.
"She has no peace these days," Edwards said.
Common Pleas Judge Mark Fleegle noted that Payton has no prior felony record but an extensive misdemeanor record, including theft and trespassing charges.
Fleegle sentenced Payton to 10 years in prison for the second rape case, to run consecutive to the 10 years to life sentence, for a total of 20 years to life in prison.
Fleegle also ordered Payton to pay $1,900 in restitution.

A father of an 11-year-old girl in West Virginia who was arrested and ultimately indicted after arranging for an abortion following a case of pregnancy following incest will avoid prison. 

West Virginia State Police say they consented to the abortion and the abortion clinic in question didn’t report the abortion to authorities.
Michael and Amanda Adkins were arrested on charges of child neglect causing the risk of injury. While some licensed medical professionals were involved in getting information to authorities, WSAZ-TV indicates the abortion clinic in Charleston that did an abortion did not report the clear case of statutory rape.
The indictment charged Michael Joe Adkins with incest, first-degree sexual assault and sexual abuse by a parent for alleged intercourse with his daughter, which impregnated the girl as the sexual activity continued after she became 12. He and the girl’s stepmother, Amanda Rea Adkins, also faced counts of child neglect creating risk of injury and conspiracy as part of an abortion and subsequent procedure aimed at covering up the alleged incest.
The sexual assaults on the girl took place between October 2010 and February 2011 and then took the girl for an abortion after the incest impregnated her on March 1. They then subsequently got her a D&C on March 16.
But a news report today indicates Adkins has merely been placed on probation.
Cabell Circuit Judge Paul T. Farrell, honoring a plea deal reached between assistant prosecutor Kellie Neal and defense attorney Connor Robertson, placed Michael Joe Adkins, of Ona, on five years’ probation and 50 years of supervision after his probation is completed.
Adkins had entered a Kennedy plea in September 2015 to incest with a young girl. A Kennedy plea allows a conviction without the defendant admitting guilt or explaining his role in a crime. He will also have to register as a sex offender and take specialized classes and therapy as part of the deal.
The pro-life movement has repeatedly documented how abortion facilities fail to report cases of statutory rape and predators using abortions to cover up their crimes.

Father Who Raped His 11-Year-Old Daughter, Took Her for Abortion, Avoids Prison STEVEN ERTELT   NOV 16, 2017

A Sheffield paedophile who sexually abused a young girl for over a year has been jailed. 

Steven Fraser, aged 25, of Perkyn Road, Shiregreen, is today starting a nine year prison sentence after he forced a girl aged under 16 to engage in sexual activity on numerous occasions between June 2015 and July 2016. 

The victim, who cannot be named for legal reasons, came forward to report the abuse last year after she confided in her mum about what had been happening to her. 

Fraser, who denied ever abusing the girl, was found guilty of four counts of rape of a child, four counts of engaging in penetrative activity with a child, one count of assault by penetration and one count of engaging in non-penetrative sexual activity with a child. 

After the sentencing at Sheffield Crown Court, detective Steve Evans and civilian investigator Amy Todd issued a joint statement praising the courage of the victim. 

They said: "The victim in this case has shown incredible bravery, coming forward to speak to us after telling her mum what had been happening to her during that time. 

“Fraser scared and intimidated her and as such she felt as though she had to comply with his atrocious demands. 

“The victim has shown immense courage in giving evidence during the trial, which has ultimately resulted in Fraser receiving this substantial custodial sentence. 

“South Yorkshire Police wish to reiterate that any report made regarding any sexual offences will be thoroughly investigated. 

"Victim’s will be listened to and we will always do everything we can to ensure offenders are brought to justice and held accountable for these horrendous crimes.” 

UPDATE | Armando Gonzalez pleaded guilty to 2 charges: lewd act w/ minor; criminal sexual conduct w/ minor 3rd degree.
Attorneys say a former Lowcountry Sunday school teacher is expected in court today. We’re told Armando Gonzalez will plead guilty to sexually abusing children.
Police say Gonzalez sexually abused children in 2010 and 2015. They say he and his wife were involved with a Salvation Army child care center in West Ashley.
Attorneys for the victims argue Salvation Army employees didn’t perform a proper background check on Gonzalez. They say employees should have discovered a history of abuse and never let him in the door.
The Salvation Army said they immediately banned Gonzalez when they learned of the history of abuse. The organization has also argued Gonzalez was a member of the church, but never employed as a Sunday school teacher or child care provider, as alleged by attorneys involved in lawsuits.
In March of this year, attorneys representing the families of the children filed negligence lawsuits against the Salvation Army.

A "depraved" Thai boxing instructor who admitted grooming and sexually abusing two young girls has been jailed.
Peter Feeley, 56, from Middleton, had regularly invited his victims to his gym for sleepovers, plying them alcohol before abusing them.
He was arrested after a girl he called his "young wife" went missing in May.
At Manchester Crown Court Minshull Street, Feeley was jailed for six years for child abduction, sexual activity with a child and indecent assault.
Police began investigating after receiving a report a teenage girl was missing from home in May.
She was found safe and Feeley, who owned Spartan Muay Thai gym, was later arrested.
His mobile phone revealed he had groomed and abused the teenager over a long period of time, once wearing a T-shirt with "Don't forget to smile" written on it, which was later seized for evidence.
During the investigation police received a further report that Feeley, of Spring Gardens, had sexually abused another victim in 2012.
Det Con Hannah Greetham said: "Feeley wrongfully used his position to exploit young girls to satisfy his appetite for depravity.
"There is no excuse for the devastating abuse he has mercilessly inflicted on these young girls' lives, who have been so brave in reporting his cruelty."

A Nederland man, Eric Scott, has been charged with one count of continuous sexual abuse of a child and three counts of aggravated sexual assault of a child.
Investigators say he abused two girls when they were both just 9.
According to an affadavit, one girl was repeatedly abused from November 2015 until March 2016. She told deputies Scott offered to buy her chewing gum if he would let her touch her inappropriately.
Deputies say the other young girl was abused 3 times, and those were recorded on Scott's cell phone.
The girl told officials she didn't remember the abuse, and after she was tested, cocaine was found to be in her system.
Before these incidents, Jefferson County Sheriff's deputies say Scott has been arrested 16 other times for unrelated offenses.
He is now being held in the East Texas Treatment Facility in Henderson, Texas on $400,000 bond.

VERNON, Texas (KETK) - A Texas man has been sentenced to 144 years in prison for sex crimes against children.
According to KFDX, Jimmie Kyle Anderson, of Vernon, was convicted of one count of aggravated sexual assault of a child and three counts of indecency with a child. 
Evidence presented during the trial revealed three children made an outcry of sexual abuse in May 2017. The children told Anderson's wife he would sexually abuse them while she was not home.
Anderson's wife notified police of the abuse and took the children to a Wichita Falls foster agency.
In May, Anderson's wife made a call to Anderson that was recorded by the Texas Rangers. During that call, Anderson admitted to the acts with all three children.
During the trial, Wichita Falls District Attorney Staley Heatly elicited testimony from three other girls who have been fostered by Anderson, Each of the girls testified that they were also sexually abused by Anderson in 2014.
Anderson was sentenced to 99 years for aggravated sexual assault and 15 years for each of the three counts of indecency with a child. 
District Judge Dan Mike Bird stacked the three 15 years sentenced on top of the 99-year sentence.
Anderson will not be eligible for parole until he's served his full 99-year stint.

Texas man sentenced to 144 years in prison for child sex crimes Nov 16, 2017 

AUBURN — A 30-year-old Cato man will likely spend the rest of his life in prison for sexually assaulting three preteen girls in Cayuga County. 
On Oct. 31, a jury found William Lewis guilty of three felonies: one count of first-degree sexual abuse and two counts of predatory sexual assault against a child. He was also convicted of three counts of endangering the welfare of a child, a class A misdemeanor. 
During the trial, Cayuga County Assistant District Attorney Heather DeStefano said that Lewis sexually assaulted three girls between November 2014 and March 2017. The abuse occurred in the towns of Cato, Victory and Sterling. 
A former mechanic's helper and substitute cleaner for the Cato-Meridian Central School District, Lewis was arrested in March following an investigation by the Cayuga County Sheriff's Office. DeStefano said Lewis' victims were between the ages of 6 and 10 when the abuse began; they were not connected to his work with the school district. 
Lewis appeared before Judge Thomas Leone for sentencing. DeStefano asked the court to impose the maximum sentence on each count — a total of 57 years to life in prison followed by 10 years post-release supervision. 
"He deserves every second of the maximum sentence," she said, noting that Lewis has continued to deny responsibility in the case. 
DeStefano said Lewis has accused the children of "making this up," despite overwhelming evidence against him. She also said he complained he was bored at trial, and was often seen doodling in a notebook or playing with a pen cap during people's testimony. 
Meanwhile, Lewis' defense attorney, Donald Kelly, said his client maintains his innocence in the matter. He asked Leone to sentence Lewis to a total of 25 years to life in prison. 
Lewis could be seen leaning back in his chair and seemed disinterested in the proceedings. When asked if he had anything to say to the court, he simply said, "No." 
"This was perhaps the most difficult case I've presided over," Leone said. "I have no respect or compassion for you." 
Leone sentenced Lewis to the maximum: 25 years to life in prison on each count of predatory sexual assault and 7 years in prison and 10 years post-release supervision for sexual abuse. Those sentences will run consecutive to one another for a maximum of 57 years to life in prison.
"(Lewis') conviction should send a loud and clear message that those who sexually abuse children will be held accountable for their actions," Cayuga County District Attorney Jon Budelmann said in a press release. "We were pleased that the court agree with our assessment that stealing the childhood from three innocents deserved the maximum sentence." 


STUART — Police arrested a Stuart man and charged him with committing "several" lewd acts on children younger than 12, according to a tweet from the department.

Manuel Thomas Rios Jr., 40, of the 1900 block of Southwest Palm City Road, was arrested on a warrant.

According to officials at the Martin County Jail, he was charged with two counts of sexual battery on a child younger than 12, two counts of lewd and lascivious molestation and two counts of intentional child abuse.

The investigation into allegation of sexual abuse began in early December. The Department of Children and Family Services received information that Rios may have molested or sexually battered three children, ages 11, 9 and 8.

According to a complaint affidavit from the Stuart Police Department, Rios would grab all three children by their genitals over their clothes and inappropriately touched the 11-year-old and the 9-year-old.

The children also said Rios punched, choked and slapped them, according to the report. 

Rios would watch the children while their mother was working, according to the report. The mother denied knowing about any sexual abuse.

According to the report, Rios also asked two of the children to touch him inappropriately

Rios was interviewed by police on Jan. 27, where he denied all allegations of sexual abuse. In early February, Rios admitted during a polygraph test at the Martin County Sheriff's Office that he may have touched the children accidentally, according to the report.

A warrant was issued for Rios' arrest, Stuart police spokesman Sgt. Brian Bossio said.

Bossio said issuing the warrant took so long because detectives wanted to "be sure that the case was thorough and accurate."

He is being held at the jail on an $850,000 bail.

A Hudson Valley man is accused of sexually abusing a 4-year-old child.

Members of the Plattekill Police Department responded to a home in Modena for a report of child sexual abuse.

A preliminary investigation revealed that 23-year-old Jesse Fitzpatrick of Modena had inappropriate sexual contact with a 4 year-old child earlier in the day, police say.

Fitzpatrick and the child live in the same home but are not related, according to the Ulster County Sheriff’s Office.

Fitzpatrick was charged with sexual abuse, a felony, and forcible touching, a misdemeanor. 

He was arraigned in Town of Plattekill Justice Court and remanded to the Ulster County Jail in lieu of $5,000 cash bail or $10,000 secured bond.

Detectives and investigators from the Ulster County Child Advocacy Center and the Ulster County Sheriff's Office continue to investigate with more charges are possible.
