HOLLIDAYSBURG -- Gary Miller was sentenced to 90 to 180 years in prison after a jury found him guilty of raping a child.
Miller, 69, of Altoona, is believed to have raped a girl from the time she was 11 years old until she was 16 years old.
Assistant District Attorney Derek Elensky said this was "the most sickening case" he'd ever seen.
Elensky said that Miller used violence, threats and gifts to control his victim. He said that control was demonstrated in hundreds of text messages Miller sent to her.
Miller denies the claims, and told the judge Thursday that he wants to appeal.
Elensky said if he does appeal, the prosecution will "fight it vigorously."
GREENVILLE, Ky. (11/2/17) — It took jurors a little more than an hour and a half to reach verdicts in the child sex abuse/case of J. L. Graham.
Graham faced six separate charges of sodomy and sexual abuse/victims under age 12 involving two victims.
The Muhlenberg Circuit Court jury found Graham guilty of four counts of first-degree sodomy and two counts of first-degree sex abuse.
Graham remained stoic during the verdict readings.
Commonweath’s Attorney Ralph Vick finished his final remarks in the trial in which Graham was accused of sex abuse and sodomy of two boys aged 8-9 at the time of his arrest in October 2016.
The jury left for its deliberation at 12:07 p.m. and returned at 2:15 p.m. with a finding of guilty on all counts.
Both boys and parents testified that Graham became trusted and loved by the victims and their families over a period of time. After the trust was gained, Graham used their trust and affection to get into intimate situations with the boys including overnight trips, Vick said in closing remarks.
Vick told jurors that Graham targeted the boys and used their love of video games to find ways to be in the boys’ bedrooms. He also said the two boys were in separate households and had separate families and that Graham was working to entrust both at about the same time.
One victim and parent testified that Graham gave the boy an expensive guitar and threatened to take it back if the boy told anyone about their activities.
Graham’s public defender James Chamberlain told jurors that both boys initially denied anything happened when asked if they had been touched inappropriately. He said the boys initially lied and had been coached in telling their stories.
Graham testified in his defense denying any wrongdoing regarding the youths. He maintained his innocence throughout the process from being charged and throughout his testimony in court, said Chamberlain in closing remarks.

A pensioner who committed a series of sexual assaults on a young girl has been jailed.

Maurice Wall, of Burnham-on-Sea, carried out the ‘prolonged non-recent abuse of his victim over a sustained period of time’, according to the Crown Prosecution Service.
Wall, aged 76 and of Ramsay Way, pleaded guilty to charges of indecent assault, indecency with a child and rape – and was sentenced 15 years and 11 months in prison at Bristol Crown Court.
He must register as a sex offender for life and is banned from working with children and vulnerable adults.
In sentencing, Judge Peter Blair QC said: “It has had long-lasting physiological effects upon your victim, for which you must have proper punishment.”
Kathryn Jones, of the CPS, said: “This has been an extremely distressing case for the victim and I must commend the bravery shown. I hope the sentence today brings some closure and now allows the victim to move forward.”

A local man was sentenced to 40 years in prison after pleading guilty in Garland County Circuit Court to sexually assaulting and grooming a 9-year-old girl in 2015.
Richard James Laquerre, 30, who has remained in custody in lieu of $1 million bond since his arrest Oct. 23, 2015, was set to stand trial but agreed that morning to plead guilty to two counts of sexual assault and one count of sexually grooming a child while three counts of rape were withdrawn.
He was sentenced to 20 years on each of the assault counts, to run consecutively, and to six years on the grooming charge, to be served concurrently, for a total of 40 years. Court costs were expunged for time served.
"We talked with the victim and her mother and we decided it was a good plea factoring in the chance he might be found not guilty," Chief Deputy Prosecutor Joe Graham said Thursday.
"The victim still wanted to testify so after he plead she bravely got on the stand and testified about what the defendant did to her even though she didn't have to," he said.
According to the probable cause affidavit submitted by Garland County sheriff's Investigator Russell Severns, the victim was interviewed at the Cooper Anthony Mercy Child Advocacy Center by forensic interviewer Tracey Childress, with the interview audio and video recorded, on Oct. 1, 2015.
The victim, who lives with her mother, stepfather and younger brother, stated a known suspect, identified as Laquerre, used to baby-sit her and her brother, and over the course of about a year he would show her pornography on a computer tablet.
Laquerre also made her watch him masturbate and forced her to perform oral sex on him, fondled her sexually and raped her. The victim described the incidents in detail and the feelings she had during them.
On Oct. 22, 2015, Severns interviewed Laquerre along with Arkansas State Police Crimes Against Children investigator Taylor Griffie, and he admitted to showing the victim pornography on a computer tablet about five times, that she watched him masturbate and that he fondled her sexually, performed oral sex on her and digitally penetrated her.
Graham noted Laquerre denied raping the victim and claimed he only digitally penetrated her "by accident."
According to Arkansas law, a person commits the act of sexually grooming a child if they knowingly disseminate to a child 13 years of age or younger, with or without consideration, a visual or print medium depicting sexually explicit conduct with the purpose to entice, induce, or groom the child, to engage in sexual intercourse, sexually explicit conduct or deviate sexual activity.

JEFFERSON — A registered sex offender from Ashtabula who was released from prison in 2016 is accused of raping a 6-year-old girl in August while working for her mother and staying at their home. He also reportedly took photos of the act.
The county grand jury indicted Juan Sanchez Jr., 44, of 6601 Fassett St., Ashtabula, on three first-degree felony counts of rape, six second-degree felony counts each of pandering obscenity involving a minor and illegal use of a minor in nudity-oriented material or performance, and two third-degree felony counts of gross sexual imposition.
The offenses reportedly occurred over the course of two days in late August at the girl’s home in Geneva Township, county Prosecutor Nicholas Iarocci said.
Sanchez was friends with the girl’s mother and worked for her in her private home business the night of the offenses. The work lasted late into the night and Sanchez stayed over at the home, Iarocci said. Sanchez entered the girl’s room while she was sleeping, raped her and took photos of the act.
After Sanchez left the home, the girl told her mother about the incident. The mother then approached Sanchez, Iarocci said, and asked to use his phone. He complied and she secretly searched the photos on his phone, finding the photos of her daughter. County authorities obtained those photos as evidence.
Sanchez was arrested Aug. 24 and has since remained in the Ashtabula County Jail. He has yet to be arraigned. Iarocci said a rape kit was also performed on the girl.
The woman had known Sanchez only a short time and was unaware of his sex offender status, Iarocci said. 
Sanchez was convicted in 1997 in Ashtabula County Court of Common Pleas of raping a juvenile.
He was paroled from prison in January 2016, after serving 17 years of a 10 years-to-life sentence. His supervision period was set to last five years.
The parole board that last considered Sanchez for release in April 2015 found he had “made an acceptable institutional adjustment” and noted his completion of programming meant to abate his high risk of re-offending, according to a report from the state Department of Rehabilitation and Correction.
GETTYSBURG, Pa. (WHTM) – State police are looking for a man accused of raping a child in Adams County.
Santos Torres-Garcia, 37, is accused of indecently touching and sexually assaulting the girl for several years when he lived in York Springs, Abbottstown, and Hamilton Township.
He was charged in August with several counts including rape of a child and unlawful contact with minors, but his current whereabouts are unknown.

MIAMI COUNTY — A Troy man will spend 10 years to life in prison for sexually assaulting a child he was babysitting in a Troy hotel room.

Charles C. Cox, 43, of Troy, entered guilty pleas to first-degree rape of a minor under the age of 13, second-degree felony pandering sexually oriented materials, and three counts of second degree felony illegal use of a minor in nudity.
Judge Jeannine Pratt informed Cox the first-degree rape charge and its mandatory 10 year to life specification is an indefinite term. The the state parole board determines Cox’s length of prison time. The other four charges carry two to eight years of prison for each count. The joint recommendation with the state recommends each sentence to be run concurrent with one another.
Cox could face up to 42 years to life in prison and a maximum fine of $80,000.
Cox entered the pleas under a bill of information, dismissing the grand jury indictment in exchange for the guilty pleas.
Cox, who cried throughout the hearing, will also register as a Tier III and Tier II sex offender following his sentencing on Dec. 12. He will serve a mandatory 25 years of post-release control for all five counts.
Cox committed the offenses while on community control.
Cox was a resident at the Budget Inn on Archer Drive in Troy during the time the offense had occurred. The minor victim was known to Cox. Troy Police Department arrested Cox in July after the victim came forward with the allegations of sexual assault.


ALTURAS, Calif. – A northern California man arrested and released on child molestation charges was re-arrested after police learned about more alleged sex crimes.
The Modoc County Sheriff’s Office said 57-year-old John Gregory Hughes of Alturas was taken into custody on October 6 on multiple counts of child molestation. The arrest was the result of an ongoing investigation by the sheriff’s office into Hughes’ “continual sexual abuse of a child.”
Hughes was booked into the Modoc County Jail on $200,000 bail, deputies said. He was released from jail later that same day after posting bond. He was scheduled to appear in court on November 7 for an arraignment.
On November 2, the sheriff’s office said Hughes turned himself in after learning he had a new warrant out for his arrest. Investigators are alleging an additional 90 counts of child molestation.
Hughes is currently being held in the Modoc County Jail on $1,000,000 bail. The investigation is still ongoing.
A Lawton man has been indicted by the Wichita County grand jury on two charges that involve sexual abuse of a child. 
Rusty Lyle White, 33, was indicted on an Indecency with a Child charge and Aggravated Sexual Assault charge. 
The indictment stemmed from an incident on September 12 of this year. 
WFPD were dispatched to a home in the 4300 block of Cunningham Drive in reference to a possible sexual assault of a child that evening around 7:48 p.m. 
When officers arrived on scene they spoke with the mother of the 5-year-old victim who said walked into her master bedroom and found White engaging in sexual acts with the child. 
There was a short standoff with police before White surrendered and was taken into custody. White was arrested and charged with Aggravated Sexual Assault.
White was interviewed by detectives where he admitted to the inappropriate behavior and said there have been similar encounters between the victim and him in the past.
White remains behind bars in the Wichita County Jail on a combined $125,000 bond.
