An Inverness man now faces a capital felony charge of sexual battery after he was accused of sexually abusing a young girl.

On July 28, the Citrus County Sheriff’s Office received an allegation that 32-year-old Gary Emerson Heinzman molested and sexually battered the girl during the summer of 2016, according to Heinzman’s arrest report. The girls is younger than 10 years old.
Soon afterward, authorities interviewed the girl, who said Heinzman entered her bedroom numerous times and abused her in various ways. She reported an alleged incident to a relative, who confronted Heinzman, who then denied the allegations.
The girl said Heinzman apologized to her but then made a lewd remark to her.
A sheriff’s detective detained and questioned Heinzman, who again denied the allegations but said it could have happened the way the girl described it, according to his arrest report.
Heinzman said he does sleepwalk.
Heinzman was charged with two counts of capital sexual battery on a person under age 18, child abuse, lewd and lascivious conduct, two counts of lewd and lascivious molestation and two counts of lewd and lascivious battery.
Bond was denied.

NORMAN — A Cleveland County jury has found Daniel Ryan Chadwell guilty on 38 out of 40 felony counts for sexually abusing of three children, two of which were his stepchildren.
During closing arguments on Friday, Cleveland County Assistant District Attorney Jennifer Austin told the jury to show Chadwell no mercy when determining his sentence, and they didn’t.
"He had no sympathy for the terrible things he did to those children. And you (the jury) shouldn't have any sympathy for him," Austin said.
The jury recommended punishment ranging from 25 to 100 years in prison for each count. Chadwell is set to appear for formal sentencing Nov. 1 before Judge Thad Balkman.
The allegations
According to a Cleveland County probable cause affidavit, Chadwell married the mother of two of the victims in 2009.
The mother, Chadwell’s ex-wife Kerry Turner, told Oklahoma City Police (OCPD) detectives during an interview that on Nov. 6, 2014 her daughter told her she had been touched by Chadwell.
About two weeks after the allegations were made, forensic interviewers at the Mary Abbott Children’s House interviewed two of Chadwell’s victims.
During the interview, Chadwell’s former stepchildren told interviewers that for about the past five years they had been molested by Chadwell multiple times.
They said Chadwell tried to keep the incidents a secret and would call it his “game," the affidavit read.
The third victim, who was the daughter of family friends, was interviewed by OCPD detectives on Dec. 10, 2014. The girl disclosed Chadwell had inappropriately touched her while she stayed the night at Chadwell’s for a sleepover about two years prior to the interview.
Chadwell was originally charged in Dec. 2014 with 36 felony counts. However, after the charges were later amended, he faced 40 counts of lewd acts with a child under 16.
The victims also offered graphic testimony about other incidents involving sex toys and a family pet.
Brandon Wood, who knew Chadwell through Turner said there was a conversation he and Chadwell had in Wood’s pool while the families were hanging out that raised a lot of concern and ultimately caused the two family’s relationship to cease.
Meanwhile, United States Secret Service agent and Moore Police Det. Chris Lamar testified during the trial that there was evidence of child pornography on Chadwell’s home computer and his personal tablet.

A Dalton man found guilty by a jury of two counts of aggravated sodomy, aggravated child molestation and first-degree cruelty to children has been sentenced to three life sentences. Under current law, Lebron Keith Hooper must serve 30 years before being considered for parole.
According to a press release from District Attorney Bert Poston, Hooper, 41, committed the offenses against a child between the ages of 9 and 10. Senior Superior Court Judge Jack Partain presided over the trial and delivered the sentence. The life sentences will be concurrent for the two aggravated sodomy and aggravated child molestation counts. Partain also sentenced Hooper to the maximum of 20 years for the cruelty to children charge, which will run concurrent with the life sentences.
According to the press release:
"In July of 2016, the then 10-year-old victim reported to her parents that the defendant was sodomizing her. In fear, the child had waited several months before reporting the incident. Detective Daniel Jones (of the Whitfield County Sheriff's Office) began investigating the case, but due to the nature of the crime and the time lapse between the act and the report, there was no physical evidence or DNA.
"Detective Jones did discover evidence the defendant had been searching for pornography depicting children engaged in sexual acts with adults in May of 2016. During the investigation, Detective Jones was able to locate and interview three other victims of the defendant. Two reported that in separate incidents just over 20 years ago, the defendant had raped them. Each of the victims testified at trial.
"A third victim testified that when she was nine years old, and the defendant was 27, the defendant began molesting her. He began by touching her inappropriately, and over a period of several years, his behavior progressed until he raped and sodomized her. None of the prior victims had disclosed their abuse to law enforcement when they occurred for fear of retribution from friends and family members and a concern they would not be believed.
"After the investigation had been closed, an inmate who had roomed with the defendant at the Whitfield County jail approached Detective Jones and informed him the defendant had been talking about and admitting his acts against the child. The inmate did not receive any consideration for his information and did testify at trial."
The press release said the jury deliberated for an hour and 12 minutes, returning guilty verdicts on all four counts in the indictment.
"Crimes against children which leave behind no physical evidence are some of the most difficult cases to prosecute," the press release said. "Without Detective Jones’ comprehensive investigation and the willingness of other victims to come forward, face the defendant and testify, it would have been much more difficult to bring Mr. Hooper to justice."
Assistant District Attorney Keely Parker was the prosecutor.

BLOOMINGTON – A Bloomington murder suspect is now facing 20 charges for allegedly sexually molesting a teenager in an unrelated case.
McLean County prosecutors filed 16 counts of criminal sexual assault and four counts of aggravated criminal sexual abuse against Kyle Brestan for alleged molestations that occurred earlier this year.
State’s Attorney Jason Chambers said the sex crimes came to light after his office in June filed charges related to manufacturing and possessing child pornography.
Brestan has been jailed since May on charges he killed Shannon Hastings, 27, of Peoria in a west side Bloomington hotel room. The coroner revealed Hastings had been stabbed approximately 105 times.
Brestan faces up to life in prison if found guilty of the murder charge.

Accused killer now faces child molestation charges  Howard Packowitz

An Iredell County man who is accused of sexually assaulting a 7-year-old girl in July is facing additional charges in the incident. 
According to the Iredell County Sheriff's Office, Brentley Jason Byers, 28, reportedly sexually assaulted the victim between July 21 and July 22 at a home on Olin Loop Road. Byers was arrested and charged with statutory rape of child by adult and given a $1,000,000 bond. 
On Tuesday, deputies filed more charges against Byers for one count of felony statutory sex offense with a child and one count of felony child abuse inflicting serious injury. 
Byers was reportedly left alone with the 7-year-old and three other children, and a family member came to pick up two of the other children on the evening of July 21, deputies say.  
The mother of the 7-year-old girl said she left for work at 7 a.m. on July 21 and returned around 1 p.m. the next day to find her daughter sitting in the chair with blood on her. That's when the girl said she had been sexually assaulted. 
"Indications were that the crime occurred during the night when only two small children and the suspect were in the home," deputies say. 
Evidence found in the home, including clothing in the washing machine, was consistent with a sexual assault, deputies say. 
The 7-year-old went to Iredell County EMS and later to Brenner Children's Hospital in Winston Salem. Deputies say the child will likely need surgery due to the extent of her injuries. 
"The victim has suffered extensive injuries from the assault," deputies say. 
Byers was given an additional $1,000,000 bond for the new charges, which increased his total bond to $2,000,500, according to deputies.
Deputies say more charges may be filed.

LAS CRUCES - A Texas man suspected of sexually abusing a 7-year-old girl was arrested last week by Doña Ana County authorities and charged with more than three dozen sexual assault charges, jail and court records show.
Guillermo Sosa, 58, of Anthony, Texas, was arrested on a warrant charging him with 26 counts of first-degree criminal sexual penetration of a minor under 13 years old and 13 counts of second-degree criminal sexual contact of a minor under 13 years old, according to court records.
Sosa remains jailed without bond at the Doña Ana County Detention Center.
The charges stem from nearly 40 incidents that occurred earlier this year from January to April.
The girl told authorities that Sosa had sexually assaulted her every time she stayed at a relative's home, according to a criminal complaint.
Sosa admitted to authorities that he "accidentally" touched the girl in an inappropriate manner and soon afterward began "having fantasies" about her, the complaint states.
He further admitted that he would walk around the house at night and inappropriately touch the girl while she was sleeping, the complaint states.
Sosa made his first court appearance on Monday, and a preliminary hearing in his case has been scheduled for Sept. 12, court records show.

A jury trial for a 25-year-old illicit sex case won’t happen until March 2018.
Lewis Clark Marshall, 57, returned to court for a hearing Monday on felony charges of sodomy and first-degree sexual abuse.
A Missouri State Highway Patrol investigation accused Marshall of illicit sexual activities with a child under the age of 9 during a three-year period between December 1990 and November 1993. The investigation reportedly identified six victims located across Northwest Missouri. Marshall also is accused of threatening to murder the child victims.
Defense attorney Rose Briscoe asked the court to set the case for a four-day jury trial.
The earliest date Briscoe, Circuit Judge Patrick Robb and Kate Schaefer, an assistant Buchanan County prosecutor, could agree on was Tuesday, March 13, 2018. A pretrial hearing will occur on Friday, March 9, 2018.
Additional criminal cases, where Marshall stands accused of sodomy and in one case rape, have been filed against Marshall in Worth and Caldwell counties.
The defendant has been denied bond because a judge ruled he’s a danger to the community. Marshall remains confined to the Buchanan County Jail.

A Candor man learned his fate for the sexually abuse of a preteen girl.
Matthew Williams, 33, was sentenced to six years in prison with ten years of post-release supervision, according to the Tompkins County District Attorney's Office.
Williams was convicted by a jury in Tompkins County Court on May 19. He was found guilty of first-degree sexual abuse and two counts of endangering the welfare of a child.
In June 2016, Williams bought alcohol for two 12-year old girls, prosecutors say, and drove them to a secluded campsite in Danby State Forest.
Officials say he gave the girls alcohol and sexually abused one of the girls in the back of a pickup truck.
The girls were located the following morning after running away from Williams and hiding in the woods for several hours.
New York State Police investigated this case.

A St. Tammany Parish grand jury indicted Ross Patrick Bernard, 40, of Ponchatoula, on two counts of aggravated rape, two counts of sexual battery on a child under 13 years old, one count of oral sexual battery, one count of sexual battery, three counts of indecent behavior with a juvenile, and one count of failure to register as a sex offender.
Bernard is accused of abusing at least five juveniles between 2012 and 2016. He also is charged with failing to register as a sex offender for a prior conviction on felony carnal knowledge of a juvenile. Bernard fled to Virginia, where he was arrested on a warrant for the current charges.

His case is set for pre-trial motion hearings on Sept. 13.
