SOUTH BEND — A 25-year-old South Bend man is facing three felony charges for sexual abuse of two young girls. Matthew Philson was charged Wednesday with one count of child molesting and two counts of attempted child molesting.
A 10-year-old girl told police she was staying the night with a friend at the home of one of the friend's relatives the night of Aug. 2. Philson was also staying at the house, according to the probably cause affidavit. During the night, Philson kept trying to pull the girl's shorts down while she was sleeping, she said.
He tried to remove her shorts more than one time, but she moved and told him to stop. The girl told police Philson said "sorry I was sleeping the whole time," when she said to stop.
The girl's 11-year-old friend who she was staying with told police Philson kept touching her privates and would touch them with his privates. The 11-year-old girl said Philson had sexually abused her two prior occasions at the same relative's house.
Philson was interviewed by Special Victim's Unit on Aug. 8 and admitted he tried to pull down the pants of the the two girls, according to court documents. When confronted about previous sexual abuse of the 11-year-old, Philson admitted he had sex with the girl on a prior occasion.
Philson is being held at the St. Joseph County Jail on a $15,000 bond. Police say Philson's eyes were already bruised when he was questioned and arrested.

MARTINSBURG, W.Va. — A 47-year-old man was ordered to serve 168 to 440 years in prison in connection with charges that he repeatedly raped and assaulted a young girl over six years beginning when she was 10 years old.
Edward William Holton, who received the maximum sentence for 23 sexual-assault and related convictions, also was fined $6,000 by 23rd Judicial Circuit Judge Michael D. Lorensen in Berkeley County Circuit Court.
The judge concluded by saying that he needed to see "some ray of hope" with the defendant in order to impose a lighter sentence and added that he didn't see any.
He also advised Holton of sexual-offender and child-abuse registry requirements.
The court imposed what appears to amount to a life sentence in the case against Holton after denying the defendant's motion for a new trial.
Holton, who told the court that he could not admit to charges that he didn't commit, insisted that there were errors in his trial and that there was a lot evidence in the case that didn't get presented to the jury.
The sexual offenses began in May 2009 and continued until September 2015, when a domestic incident was investigated by the Berkeley County Sheriff's Department, records said.
Berkeley County Assistant Prosecuting Attorney Hassan Rasheed told the court there was evidence in the case that the defendant brutally assaulted the girl, treating her like "a sexual plaything" in actions that were "beyond reprehensible."

Ernest James Snyder Jr., 27, of Hermitage, was arrested at 3:27 p.m. Thursday in Potter Township.
The arrest stems from charges out of Hermitage, Mercer County, where the child lives. The charges include felony rape of a child, felony aggravated indecent assault of a child younger than 13 years old and felony indecent assault of a child younger than 13 years old.
The girl and her mother filed a report on Aug. 7 with Hermitage police, detailing three sexual assaults from May through July.
The first incident occurred when Snyder and the girl were fishing together and he directed her to perform a sexual act on him, according to an affidavit of probable cause. The next two incidents occurred in the apartment where the girl and mother live and while Snyder and the girl were alone. In the second incident, he raped her and in the third directed her to allow him to perform a sexual act.
Snyder admitted to the first two incidents in an interview with police and told authorities he would kill himself before going to jail, according to the affidavit. He allegedly told police there had been four incidents of sexual assault but did not elaborate on the last two encounters.

Bobby Lee Smith, 54, of Princeton was arraigned before Magistrate Sandra Dorsey on charges including 30 counts of first-degree sexual assault, each carrying a possible penalty of 25 to 100 years in prison. There were 30 charges of incest with potential terms of five to 15 years in prison, and 30 charges of sexual abuse by a parent, guardian or custodian; each has a possible term of 10 to 20 years in prison. He was also charged with one count of child abuse resulting in injury.
Detective K.L. Adams of the Mercer County Prosecuting Attorney’s Office said in his report that he was tasked with investigating the physical and sexual abuse of two female juveniles. The abuse occurred when they were in grade school and continued until both were in middle school. Both the alleged victims are now adults.
In an interview with Adams, one female said the abuse started when she was in the third or fourth grade. Smith told her that he wanted to check her for ticks and started rubbing her breasts on the outside of her clothing, and put pressure on her privates from the outside of her clothing.
The female said this happened numerous times while she lived with Smith, Adams stated. There were other instances when Smith would attempt to have anal sex with her, and she described one occurrence when Smith beat her with a belt and left bruises.
The second female said that Smith started to sexually abuse her when she was in the second grade, putting his finger down her pants and touching her privates, Adams said in his report. The second female also started that Smith started “making her give him oral sex at least twice a week.”
Dorsey set a $1 million cash or surety bond. Smith would have to raise $100,000 in order post a surety bond, she said.
“Mam, I’d like to state that I stay at home and don’t go nowhere,” Smith told Dorsey. Smith, who uses a cane, and was breathing heavily when Adams escorted him into the courtroom.
“Sir, that doesn’t matter,” Dorsey replied. “We’re looking at the severity of the charges and making sure you show up in court.”
