More than 18 years and possibly life behind bars awaits an East Peoria man with his guilty plea Monday to sexually assaulting a girl for six years before she turned 13.
Roger Stiver, 50, is a serial child rapist, according to evidence a prosecutor said she would have brought had Stiver’s case gone to trial on charges with 60-year maximum sentences that could have been imposed consecutively.
Stiver kept hope of future freedom alive when he was sentenced to 20 years on three charges of predatory criminal sexual assault of a child under 13 and three more years on two charges of aggravated criminal sexual abuse of a child under 18.
He must serve at least 85 percent of the 20-year term and half of the three years, for a total of 18 1/2 years. He’ll be given credit for 67 days in custody since his arrest.
State law will keep Stiver incarcerated indefinitely if a psychological evaluation reveals him to be a sexually dangerous or violent person.
Stiver sexually assaulted the girl over six years after meeting her in 2011, when she was 7, according to a prosecutor’s court affidavit that was heavily redacted to protect the victim’s identity.
The assaults continued for two more years until May 2016, the affidavit stated. Stiver came under investigation last January, when the girl’s school counselor reported that she had disclosed Stiver’s crimes to her.
His prosecutor told Tazewell County Circuit Judge Stephen Kouri that the investigation revealed two other girls who described similar sexual assaults by Stiver against them. He was not charged in those cases in return for his guilty pleas.
Detectives also learned Stiver was under investigation for alleged similar assaults against another girl 15 years ago, for which no charges were filed, the affidavit stated. He has no prior criminal record in Tazewell or Peoria counties.
In an unrelated case, Matthew Bickel, 35, of Peoria, was sentenced Friday to four years of sexual offender probation for sexually abusing a Pekin girl.
Bickel pleaded guilty last March to sexual abuse of a child under 13.
A Franklin County man has been charged with rape of a 9-year-old.
Butch A. Marion, 30, was charged Monday in Franklin County Associate Circuit Court with one felony count of first-degree rape or attempted rape, wantonly vile. He is being held on a $100,000 cash only bond.
Court documents list Marion as having a Pacific address. Washington police said he was living in Washington.
Police allege Marion engaged in a sex act with a 9-year-old at his residence.
According to the probable cause statement filed in the Franklin County Prosecutor’s Office by Washington police, Marion lived in Washington with a woman and three children. Police said Marion, who normally comes home from work at 6 a.m., came home Friday, June 30, at 6 p.m.
The woman told police Marion was drunk and the two began to argue. A short time later, the woman left to buy cigarettes at a local convenience store.
When the woman returned home, police said she found Marion and a 9-year-old in the bathroom “engaged in a sex act.” The woman grabbed the child, and her two other children and left the house.
The victim was taken to Mercy Hospital Washington and eventually transferred to a hospital in St. Louis.
Washington police said more charges could be pending against Marion following his arrest.
First-degree rape of a child less than 12 years old carries a required term of “life imprisonment without eligibility for probation or parole until the offender has served not less than 30 years of such sentence or unless the offender has reached the age of 75 years and has served at least 15 years of such sentence.”
The required term for a “wantonly vile” case is life imprisonment without eligibility for probation, parole or conditional release, according to the Missouri Revised Statues Section 566.030.1.
Marion was scheduled to appear in court Monday, July 3.

PENN YAN -- Dale L. LaBell, 63, of Dundee was found guilty after trial of the class D violent felony, sexual abuse in the first degree, as well as the misdemeanor charge of endangering the welfare of a child. 

According to Yates County District Attorney Valerie Gardner, LaBell could face up to seven years in prison, plus a period of up to 10 years of post-release supervision when sentenced on a date yet to be scheduled by the Yates County Court. He will also be required to register as a sex offender.

The indictment handed down by a Yates County Grand Jury in December of 2016, after presentation by District Attorney Gardner, charged LaBell with subjecting a nine-year-old female child to sexual contact at LaBell's Shannon Corners Road residence in August, 2016. 

LaBell, who has been in Yates County jail since his arraignment Dec. 16, 2016, subsequently waived his right to a jury trial. Opening statements and testimony began Tuesday, June 20, 2017 and continued through final arguments Friday, June 23. Gardner prosecuted the case on behalf of the People of the State of New York and the defendant was represented by Yates County Conflict Defender, Tiffany Sorgen. Yates County Court Judge Jason Cook handed down the guilty verdict on all counts in open court Wednesday, June 28.

Gardner stated, "I am pleased that justice for this young girl and her family has been served. These cases can be very difficult and traumatic for young victims. The support provided by NY State Police Investigator Diane Trickey, the DA's Office Victim Advocate Caitlyn Metz of Safe Harbors, and the victim's family was ever present, as was the courage of a very brave little girl."

Dundee man found guilty in sexual abuse trial July 4, 2017

A 51-year-old man has been jailed for six years for sexual activity with a child in Stratford.

Jonathan Craddock, from Kenton Way in Basildon, began abusing the girl in 2004 when she was under 13, and continued for seven years.
Det Con Janet Glover praised the victim for reporting her ordeal in 2015: “This victim was a vulnerable child when she was systematically abused by an adult she trusted.
“The courage she has demonstrated in coming forward is commendable and I hope that today’s verdict not only provides this brave young woman with a measure of closure, but that her actions inspire others who have suffered abuse to come forward and speak with police.”
Craddock was found guilty of five counts of sexual activity with a child aged under 13 years and one of sexual activity with a child aged 13-17 years at Snaresbrook Crown Court on Friday June 30.
He was found not guilty of one count of possessing indecent images of a child.

A man who raped a teenage boy in East Lothian and sexually abused another youth has been jailed for six years.
The High Court in Edinburgh heard how the boy was aged 14 when Graham Borthwick started abusing him in 2010.
Borthwick repeatedly sexually assaulted the teenager over the next two years, and on one occasion raped him in a house in Musselburgh.
He was also convicted of sexually abusing another boy in Edinburgh between 1999 and 2009.
Borthwick, 50, was convicted last month following a trial at the High Court in Glasgow. When he appeared for sentencing, Lord Summer ordered him to be supervised for three years following his release from custody.
Borthwick is currently serving a seven-year prison sentence after being jailed in 2012 after being convicted of abusing three young boys.

Predatory paedophile Jackie Greer Johnston could have been stopped in his tracks after he gave an 11 year girl a sexually transmitted infection over 20 years ago.

The forner LVF hard man, sentenced last week for eight sexual offences, had sold the little girl for sex to another man in the grounds of a north Down school, and they were caught by a staff member who reported it.
Tests showed that Johnston and the girl had the same STI, and police tried to have him prosecuted for child abuse.
But the case was knocked back by prosecutors, allowing Johnston to continue preying on young girls for another decade. He was still committing rape in 2005.
The loyalist money lender also took his revenge on the 11 year old girl because she had revealed what he'd done to her.
His victim's extended family were targeted by Johnston and his thugs, who vandalised cars and smashed windows of their homes.
Johnston was given a five year sentence last week for eight sex offences against two women. In April the dangerous paedophile had pleaded guilty to two charges of gross indecency, two of unlawful carnal knowledge and four of indecent assault, all committed between 1987 and 1994.
He is already serving a 16 year sentence for a campaign of abuse against one young woman, which started with rape when she was just 10 and continued into her twenties.
In February the 47 year old was found guilty of a 2002 rape and given a further five years.
The two women involved in the latest case have both spoken to Sunday World about their ordeal at Johnston's hands, which continues to affect their lives. Their identities are protected.
Beth, now 38, attempted suicide at 13, ran away from home and eventually fled Northern Ireland for a new life in England.
Johnston had wormed his way into her trust and would regularly turn up at a youth club she attended in the Queen's Hall in Holywood to abuse her. He also forced her into unprotected sex, on one occasion in a coal shed.
"He would take me up on the stage in the hall behind the curtain and make me perform oral sex on him," she says.
"At about 11 he was organising for me to have sex with other people. I got caught having sex with this guy he had organised when he turned up at a weekend event at my school and a member of staff caught us.
"That was how the police got involved and the medical examination showed Johnston and I both had the same STI.
"The police tried to get him prosecuted but the DPP wouldn't take it up, and then my parents tried to take a private prosecution, but they couldn't get the police files. My parents tried so hard."
Even as a child Beth knew that the LVF man was feared in Holywood, and when he threatened her she took it seriously. 
"He had always said if I told anyone he would harm my family. He was in the LVF, everyone was scared of him.
"I held back some information at 11 because of the threat of reprisals, and they happened anyway. He slashed tyres on cars, he broke windows."
Beth welcomed the latest prosecution but says she doesn't believe Johnston's apology to his victims.
"I'm not saying he ruined my life but he affected it. I still shower a couple of times a day. I have to feel clean.
"In court they said he was apologetic but that was only for the court."
Clare, whose statement led to Johnston's guilty plea to the four indecent assault charges, says his attacks on her led to suicide attempts, mental health issues and the breakdown of her marriage.
The predator's first indecent assault on her took place in Queen's Hall in Holywood when he mistook her for Beth.
"It was in the dark behind the curtain and I asked him what he was doing and he said he thought I was her. That was the first time he touched me. From the age of eight I knew what he was doing to her."
Johnston continued to target Clare, plying her with drugs and then forcing her to perform sex acts on him.
"He said if I told my parents he'd tell them I was taking drugs," says Clare, 38.
She's relieved that Johnston's guilty pleas spared her the ordeal of a trial, but believes he did it to avoid a longer sentence.
Clare also hoped the legal process would be a new beginning for her.
"I thought this would be the start of the rest of my life but some days I'm up and some days I'm down. My mum says it's like grieving. I've spent so many years feeling guilty and vulnerable.
"I was glad I didn't have to go through a trial. Maybe he pleaded guilty for us, maybe he did it for himself," she says.
A prior sex offender has recently been indicted with several more felony charges after police say he sodomized and raped a young girl.
Levi Berg, 28, of Farmington, is now being charged with three felonies of statutory sodomy in the first degree and a felony of statutory rape.
“In this case we had more evidence come forward than we did initially,” said St. Francois County Prosecuting Attorney Jerrod Mahurin. “If it is a sexual act it can be charged as rape, and if it’s touching then you can charge statutory sodomy. There were multiple different things that occurred which allowed the grand jury to add the different charges.”
Mahurin said the grand jury decided to add the additional charges. The original case, with a felony charge of sodomy in the first degree, was dismissed because of the new case coming into play.
“This case will move very rapidly since both sides already have all of the discovery back and forth,” explained Mahurin. “My guess is that probably within a month we will get a 491 (hearing) set and the trial will be very quickly thereafter.”
Mahurin said this does happen from time to time, especially with sex cases of this type.
The initial charge of a felony of sodomy in the first degree for knowingly having deviate sexual intercourse with a young girl less than 14-years-old by use of forcible compulsion was first filed in August 2016.
According to a probable cause statement, on July 28, 2016, the victim’s mother went to the St. François County Sheriff’s Department office and reported that while her young daughter was staying at a friend’s house in Bonne Terre that Berg touched her inappropriately.
The mother said her daughter told her that after everyone went to bed, Berg went into the room she was staying in and asked for a blanket. The girl said that Berg jumped on top of her and made her do stuff with him.
The report said Berg made her perform sex acts with him and she asked Berg to stop. The victim reported that Berg said if she told anyone he would get her.
The report said that same day a deputy went to Berg’s house to talk with him. The deputy reported that after informing him of his rights, he asked Berg what happened that night and Berg told the deputy that after everyone went to bed he went into the room where the young girl was and asked for a blanket.
Berg reportedly told officers they talked for a little while and then they started “wrestling”. The deputy asked what that meant, and Berg said they were just playfully wrestling with each other. The deputy asked Berg is he touched the young girl and Berg stated he did not.
The deputy then asked Berg if the victim touched him and he said she did, but he told her to stop. When asked if anything sexual occurred, Berg stated nothing else happened.
Berg has a previous history of sexual offenses and is a registered sex offender. When he was 25 he was found guilty of statutory rape in the second degree of a 16-year-old girl. He was sentenced to two years in prison, but was credited with time served since he had been incarcerated for more than two years in the county jail awaiting trial.
A jury had found Berg guilty of one Class C felony of second-degree statutory rape, but not guilty of the other charges being pursued, which included one count of statutory rape; three counts of statutory sodomy; and two counts of child molestation. Berg also has a misdemeanor assault in the third degree charge on his record.
Berg had once worked for an area city as a meter reader and volunteer firefighter. He was arrested in October of 2012 after a 16-year-old girl’s father, who also worked for the city, found inappropriate text messages on the girl's cell phone.
Although the text messages didn’t mention an ongoing sexual relationship specifically, Berg admitted during questioning that he had sex with the minor.

PARKERSBURG — A Parkersburg man has been charged with three counts of third-degree sexual assault after forcing himself on a teenage girl.
According to Wood County Magistrate Court records, Philip John Wilson Jr., 31, of 2503 Beverly St., Apt. 20, Parkersburg, was arrested June 23 for actions that occurred on or around May 5.
A 13-year-old girl was spending the night at the apartment with a female relative, the criminal complaint says. While he and the girl were alone, Wilson engaged in sexual intercourse with her, despite her attempts to resist, the criminal complaint said.
Wilson originally was charged with one count of sexual abuse by a parent, guardian or custodian to a child. That charge was dropped Monday and Wilson was charged with three counts of sexual assault in the third degree.
Wilson has pleaded not guilty to all charges.
Wilson is being held at the North Central Regional Jail on a $150,000 surety bond.

Parkersburg man charged with sexual assault JUL 6, 2017

RIVERSIDE – A man who sexually assaulted a young girl in a bathroom stall at the Riverside restaurant where he worked as a cook is slated to be sentenced today to 15 years to life in state prison.
Avimael Lopez, 35, last month admitted one count of forced oral copulation of a child under 10 years old as part of a plea agreement with the Riverside County District Attorney’s Office. In exchange for his admission, prosecutors dropped a related charge of lewd acts on a minor.
Superior Court Judge David Gunn is expected to certify the terms of the plea deal and impose the sentence stipulated by the prosecution and defense.
Lopez is being held without bail at the Robert Presley Jail in Riverside. The defendant was arrested in June 2016 after he was caught in the act of molesting the victim, identified in court documents only as Jane Doe.
According to Riverside police, the girl was with her mother at Punjab Palace in the 1700 block of University Avenue, just off of Chicago Avenue, and went into the women’s restroom alone in the early afternoon of June 6. Lopez followed the child into a stall and sexually assaulted her, police alleged.
When the girl failed to emerge after a few minutes, her mother went to check on her and encountered Lopez committing the assault, prompting the woman to call 911, according to investigators.
Detectives from the police department’s Sexual Assault & Child Abuse Unit were sent to the location and interviewed all parties, after which the defendant was jailed.
According to U.S. Immigration & Customs Enforcement, Lopez is a Mexican national who was deported back to his homeland in 2010. It’s unclear when he re-entered the U.S. illegally.
ICE has an active detainer on the defendant, who will be taken into federal custody and subject to deportation proceedings after he completes his prison term.
